Terms of Service
Last updated: 2 September 2026
These terms govern your use of KOLab WhatsApp Funnels (“the Service”), operated by KOLab Technology Limited (“KOLab”, “we”, “us”). By creating an account you agree to them.
1. What the Service does
The Service lets a business connect its own WhatsApp Business Account and build automated follow-up sequences, manage contact lists and tags, and reply to conversations. We are a technology provider: you contract with Meta for WhatsApp messaging and pay Meta directly for it.
2. Your account
You are responsible for the accuracy of your account details, for keeping your credentials secure, and for everything done under your account. You must be authorised to act for the business whose WhatsApp Business Account you connect.
3. WhatsApp Business Platform obligations
Your use of the Service is also subject to Meta's WhatsApp Business Messaging Policy, WhatsApp Business Solution Terms, and Commerce Policy. In particular you agree that:
- You will obtain and retain valid opt-in from every person before sending them a marketing message, naming both your business and WhatsApp at the point of consent.
- You will honour opt-out requests promptly and will not message anyone who has opted out.
- You will categorise message templates honestly as marketing, utility, or authentication.
- You will not use the Service to message about prohibited or regulated goods and services.
- You will not use the Service to provide a general-purpose AI assistant or open-ended chatbot over WhatsApp. Meta prohibits this.
- You will not upload contact data you have no lawful basis to process.
We may suspend or terminate access where we reasonably believe these obligations are being breached, including where Meta requires us to.
4. Data protection
For contact and message data, you are the data controller and we act as your processor, processing only on your documented instructions. Our Privacy Policy describes what we handle and how.
5. Fees
Subscription fees for the Service, where applicable, are set out at the point of purchase. WhatsApp conversation charges are billed to you by Meta directly and are not part of any fee you pay us.
6. Availability
We aim to keep the Service available but do not guarantee uninterrupted access. Message delivery depends on Meta's platform, which we do not control.
7. Termination
You may close your account at any time. On closure we disconnect your WhatsApp Business Account from our app and delete your data in line with the retention periods in the Privacy Policy.
8. Liability
To the maximum extent permitted by law, the Service is provided as-is, and we are not liable for indirect or consequential loss. Nothing in these terms limits liability that cannot lawfully be limited.
9. Changes
We may update these terms. Material changes will be notified by email at least 14 days before they take effect.
